NYS Department of Labor | Unemployment Insurance Benefits FAQ - Updated 3/31/20
On March 27, 2020, the President of the United States signed a law that provides additional Unemployment Insurance (“UI”) assistance to workers impacted by COVID-19. This new law provides:

As our nation’s restaurants assess how the CARES Act will allow them to weather this
unprecedented storm, we would like to offer our perspective on ways in which the Trump
Administration’s implementation of the Act can ensure the largest scope of eligibility and
maximize recovery efforts for our industry. If not addressed through statutory construction,
many provisions of the legislation will carry unintended consequences and block certain
businesses from accessing the programs being offered, stifling the success of the

Announcement Regarding Relief from Certain Filing and Payment Deadlines due to the Novel Coronavirus
Governor Cuomo has issued an executive order authorizing the Commissioner to provide relief from certain tax filing and payment deadlines. Accordingly, the Commissioner has extended the April 15, 2020 due date to July 15, 2020, for New York State personal income tax and corporation tax returns originally due on April 15, 2020. In addition, the Commissioner is allowing taxpayers to defer all related tax payments due on April 15, 2020, to July 15, 2020, without penalties and interest, regardless of the amount owed. National Restaurant Association Statistical Infographic of COVID-19 Impact
A survey of 4,000 restaurant owners and operators reveals the devastating economic losses sustained by the industry in just three weeks. In that time, more than 3 million restaurant employees have been laid off, and roughly one-half anticipate doing more of this (layoffs and hours reduction) during the next 30 days. Additionally, nearly two-thirds of operators have reduced their hours of operation. Infographic HERE.
Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”)
Congressional leaders released the final text of their $2 trillion coronavirus rescue package. The agreement includes a dramatic expansion of unemployment insurance, a rescue fund for state and local governments, immediate cash for hospitals, and a huge pool of grants and loans for small businesses.

Governor Cuomo Provides Updates on Issues Important to Restaurants
At his press conference today, Governor Cuomo responded to a number of issues the Association has been asking him to address.
- The first announcement was that he is barring all non-essential businesses from opening. RESTAURANTS ARE NOT AFFECTED BY THIS. Restaurants have been deemed essential and can remain operating for takeout and delivery only.
- Gov. Cuomo then announced that the state is barring all commercial and residential evictions for 90 days. This should be a help to restaurants who are facing monumental financial challenges as rent comes due.
- Finally, the Governor’s budget director stated that no penalties or interest will be charged to anyone who pays their sales tax late. This was a priority for the NYS Restaurant Association as this sales tax payment is going to be a huge lift for many restaurants. We encourage you to file your state sales tax even if you are unable to pay at this time.

Letter to Governor Cuomo Asking State to Delay 3/20 Sales Tax Payment
"On behalf of our industry, we wholeheartedly applaud your leadership in this very difficult time. It will come as no surprise to you that brick-and-mortar independent restaurants across the state are suffering this week — many have already shut their doors, never to reopen, and forced to lay off their employees. With this crisis developing so rapidly, there was no time to prepare, and now with the shutdown in place, the pain is already setting in. This industry that makes our state so special is feeling immense pressure and we need help. That is why I am writing to you, asking for some immediate, short-term relief by having the state delay the sales tax payment that is due Friday, March 20, 2020."

We at the New York State Restaurant Association greatly appreciate all of you reaching out with information on how you are managing this crisis, with questions about how to proceed and ideas on how we, or the government, can help. It has been invaluable to our staff in determining strategy and our response.
In the days ahead, please keep updating us on your status and let us know how delivery and takeout is working for you. We will continue to push every level of government for relief from taxes and fees and insist on urgent economic aid. We won't stop fighting for the restaurant industry in New York. NYS Department of Labor | Unemployment Insurance Benefits FAQ - Updated 3/31/20
On March 27, 2020, the President of the United States signed a law that provides additional Unemployment Insurance (“UI”) assistance to workers impacted by COVID-19. This new law provides:
- Pandemic Unemployment Assistance – Extended eligibility for individuals who have traditionally been ineligible for UI benefits (e.g., self-employed workers, independent contractors);
- Pandemic Unemployment Compensation – An additional $600 per week, on top of regular benefits, to all UI recipients;and,
- Pandemic Emergency Unemployment Compensation – An additional 13 weeks of UI benefits, beyond the regular 26 weeks already provided, for a total of 39 weeks of coverage.
