Labor Department Announces Final Rule Amending Overtime

The Obama Administration announced that the U.S. Labor Department's final rule establishes a new overtime pay threshold of $47,476 a year ($917 per week) for those working more than 40 hours a week, up from $23,660 per year. Additionally, the new rules will allow for future increases every three years.

This means that any salaried employees earning less than the new threshold will have to be paid overtime for hours worked more than 40 hours in a week, effective December 1, 2016. The new rule makes no changes in the duties tests used to determine whether a salaried employee above the threshold is considered an executive, administrative or professional employee and thus exempt from overtime pay. Our partners at the National Restaurant Association have been a leading voice against these rules and have vowed to pursue every available means to protect the industry.
