Will the Proposed Plastic-Bag Fee Affect Your NYC Restaurant?

No. The proposed plastic-bag fee does not apply to sellers of on-the-go food or liquor. Restaurants in New York City will not be affected by the proposed plastic-bag fee. Other retailers including grocers, bodegas, clothing stores, and other similar merchants will be affected by the proposed legislation.


This Wednesday, City Council will be hearing testimony regarding the proposed implementation of a 10-cent fee on plastic and paper shopping bags. Similar ‘bag fees’ have already been implemented in California, District of Columbia, Hawaii, and North Carolina. Other states that currently have pending legislation include Massachusetts, New Jersey, Rhode Island, and Puerto Rico.


The New York State Restaurant Association has been reviewing all upcoming legislation very carefully and continuing to meet with various city departments to ensure restaurant needs are being heard.
